Wollongong Russell Vale appeal rejected

Wollongong Coal has lost its legal attempt to have a critical review by the New South Wales Planning and Assessment Commission (PAC) into the expansion of its Russell Vale coal mine set aside.
The review had raised a number of concerns that Wollongong would need to address before any planning decision could be met, including the risk of water loss to reservoirs, land subsidence and the mine’s impact on upland swamps.
“Wollongong Coal is disappointed with the decision and will consider its appeal options in respect of it,” the company said in a statement.
In addition to a potential appeal of the Land and Environment Court decision, the company said it would “consider its options for progressing this application”, noting that neither the PAC report or court decision prevents progression of the application.
It has previously said that the mine, which has been in care and maintenance since last year, would be financially unviable if the expansion plan was rejected.
The expansion plan would see the mine extract 4.7 million t of coal from eight new longwall panels over five years.
